Each party is acting on its own behalf, and IronPlanet is not a party to the subsequent purchase contract for items that is entered into between you and the customer. Nor do we represent either party in the conclusion of any purchase contract. All sales in the Private Marketplace may be subject to Terms & Conditions of IronPlanet's customer. Please review any such Terms & Conditions before bidding on items in the Private Marketplace.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE PRIVATE MARKETPLACE, PROVIDED BY OR THROUGH IRONPLANET IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND WHETHER, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL IRONPLANET BE LIABLE FOR ANY SPECIAL, INDIRECT, PUNITIVE, COVER, INCIDENTAL OR CONSEQUENTIAL DAMAGES, HOWEVER CAUSED, WHETHER IN CONTRACT OR TORT OR UNDER ANY OTHER THEORY OF LIABILITY, INCLUDING WITHOUT LIMITATION, LOSS OF REVENUE, ANTICIPATED PROFITS, BUSINESS, OR SALES, ANY LOSS OF GOODWILL OR REPUTATION, OR THE COSTS OF SUBSTITUTE GOODS OR SERVICES, EVEN IF IRONPLANET OR AN AUTHORIZED REPRESENTATIVE THEREOF HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Any item that is not picked up within the (10) ten calendar days of the sale date or by posted the removal deadline, the item will be considered abandoned and re-sold by the City of Bethlehem unless otherwise noted in the Marketplace Terms & Conditions. All abandonments are non-refundable.
